Estas Condiciones de Uso («Condiciones») regulan tu acceso y uso de la aplicación móvil ViaTest («la aplicación» o «ViaTest») y de su contenido. Al descargar, instalar o usar la aplicación aceptas estas Condiciones; si no estás de acuerdo, no la uses.
El proveedor de la aplicación es Aleksandr Zakrenichnyi, con domicilio en Avda. Mare Nostrum 15, 46120 Alboraya, Valencia, Espana («nosotros»). «ViaTest» es el nombre comercial del producto. Puedes contactarnos en support@teorico.autos.
Estas Condiciones se complementan con nuestra Política de Privacidad, que forma parte del acuerdo entre tú y nosotros.
Para realizar compras dentro de la aplicación debes tener capacidad legal para contratar. Los menores de edad solo deben usar la aplicación con el consentimiento y bajo la supervisión de quien ejerza su patria potestad o tutela. Si usas la aplicación en nombre de otra persona o entidad, declaras que tienes autorización para aceptar estas Condiciones por ella.
ViaTest es una herramienta educativa para practicar y prepararte para el examen teórico de conducir de la DGT (Dirección General de Tráfico): tests de práctica con explicaciones y estadísticas de progreso.
El contenido (preguntas y explicaciones) es material de estudio elaborado por nosotros con fines de práctica; puede contener errores o no reflejar la normativa de tráfico vigente en cada momento. Consulta siempre la información oficial de la DGT.
Importante: ViaTest no está afiliada, patrocinada, avalada ni vinculada de ningún modo a la DGT (Dirección General de Tráfico) ni a ningún organismo público. Las preguntas de la aplicación son material de estudio, no son las preguntas oficiales del examen. Usar la aplicación o «aprobar» dentro de ella no garantiza que apruebes el examen oficial de la DGT. El resultado del examen oficial depende exclusivamente de la DGT y de tu propia preparación.
«DGT» y «Dirección General de Tráfico» son denominaciones de su titular y se utilizan aquí únicamente con fines descriptivos e identificativos del examen para el que ViaTest sirve de preparación, sin sugerir vínculo, patrocinio ni aval alguno.
Al usar la aplicación se crea automáticamente una cuenta de Firebase (anónima por defecto). Puedes vincular una cuenta de Google o tu correo electrónico para que tu progreso y tus compras se conserven al reinstalar la aplicación y se sincronicen entre tus dispositivos.
Eres responsable de tu cuenta y de mantener la confidencialidad de tus credenciales de acceso, así como de la actividad realizada a través de ella. No serás responsable de la actividad no autorizada en tu cuenta cuando dicho acceso no autorizado sea atribuible a un incumplimiento o fallo de seguridad por nuestra parte y no a un uso negligente de tus credenciales. Avísanos en support@teorico.autos si detectas un uso no autorizado de tu cuenta.
Te concedemos una licencia personal, limitada, no exclusiva, intransferible y revocable para usar la aplicación y su contenido únicamente con fines personales y no comerciales.
Salvo en la medida en que la ley lo permita expresamente, no puedes: copiar, reproducir, extraer de forma masiva o mediante «scraping», redistribuir, revender, sublicenciar, alquilar ni publicar la aplicación o su contenido; descompilar, aplicar ingeniería inversa o intentar obtener el código fuente; ni eludir, desactivar o interferir en las medidas de seguridad o de verificación de integridad (incluidas App Check y Play Integrity).
ViaTest ofrece suscripciones de renovación automática de distintas duraciones (por ejemplo, 3 meses, 6 meses y anual) y, opcionalmente, una compra única «de por vida» («lifetime»). La compra «de por vida» otorga acceso a las funciones premium mientras la aplicación siga estando disponible y operativa; «de por vida» se refiere a la vida útil del producto y no constituye una garantía de disponibilidad perpetua e incondicional del servicio.
Las suscripciones se renuevan automáticamente hasta que las canceles. El pago de la renovación se cobra a través de tu cuenta de la tienda al inicio de cada nuevo periodo, al precio vigente. La suscripción se renueva automáticamente salvo que la canceles al menos 24 horas antes de que finalice el periodo en curso, desde la configuración de tu cuenta en la tienda (Google Play o, cuando proceda, Apple App Store).
Si el precio de tu suscripción aumenta, te lo notificaremos a través de la tienda antes de que el nuevo precio se aplique en la siguiente renovación; podrás cancelar antes de esa renovación si no estás de acuerdo. El nuevo precio solo se aplicará tras dicha notificación y, cuando la tienda lo requiera, tu consentimiento.
Los precios y la moneda que ves en la aplicación los facilita la tienda y pueden variar. Antes de confirmar la compra, la tienda te muestra la duración de cada plan, el precio por periodo y las condiciones de renovación; la compra solo se completa cuando la confirmas en la tienda. Todos los pagos los procesa la tienda (Google Play o Apple App Store); nosotros no recibimos ni almacenamos los datos de tu tarjeta. Los impuestos aplicables se aplican según las reglas de la tienda y de tu país.
Puedes cancelar tu suscripción en cualquier momento desde la configuración de tu cuenta en la tienda; la cancelación surte efecto al final del periodo de facturación en curso y conservas el acceso hasta entonces. También puedes gestionar o cancelar la suscripción directamente en Google Play o en el App Store. La compra «de por vida» es un pago único y no se renueva.
Los reembolsos se rigen por la política de la tienda (Google Play o Apple App Store), que gestiona los cobros. Te recomendamos dirigir las solicitudes de reembolso a la tienda correspondiente. Si la política de la tienda no resuelve tu solicitud y la ley te reconoce un derecho, puedes contactarnos en support@teorico.autos.
Si eres consumidor en la Unión Europea, dispones de un derecho legal de desistimiento de 14 días desde la compra de contenidos o servicios digitales, sin necesidad de justificación. No obstante, para los contenidos y servicios digitales este derecho puede extinguirse si, al comprar, solicitas expresamente el inicio inmediato de la prestación y reconoces que, al hacerlo, perderás el derecho de desistimiento una vez iniciada la ejecución. Si no concurren esas condiciones, conservas íntegramente el derecho de desistimiento y, en su caso, el reembolso. La gestión de este consentimiento y de los reembolsos se realiza a través de la tienda. Para la compra «de por vida», al tratarse de un contenido digital de acceso inmediato, se aplican estas mismas reglas. Nada de lo anterior afecta a los derechos que la ley te reconozca de forma imperativa.
Podemos modificar, actualizar, suspender o discontinuar funciones de la aplicación, total o parcialmente, para mejorarla, por motivos técnicos, legales o de seguridad. Procuraremos que estos cambios no afecten de forma sustancial e injustificada a las funciones premium que ya hayas adquirido durante su periodo de vigencia.
Si discontinuamos de forma permanente una función premium esencial que hayas adquirido y aún estés disfrutando dentro de su periodo de vigencia, podrás solicitar la cancelación de la suscripción y, en su caso, el reembolso proporcional a través de la tienda conforme a su política; ello sin perjuicio de tus derechos imperativos como consumidor.
Te comprometes a usar ViaTest conforme a la ley y a estas Condiciones. En particular, no debes: usar la aplicación de forma abusiva, fraudulenta o que perjudique el servicio o a otros usuarios; acceder a ella mediante medios automatizados, «bots» o de forma masiva; sobrecargar o intentar vulnerar la infraestructura; ni eludir o interferir en las medidas de seguridad y de verificación de integridad (incluidas App Check y Play Integrity).
La aplicación, su software, diseño, textos, preguntas, explicaciones, imágenes, bases de datos y demás contenido, así como las marcas, nombres y logotipos de ViaTest, son de nuestra titularidad o de nuestros licenciantes y están protegidos por la legislación de propiedad intelectual e industrial. Estas Condiciones no te transfieren ningún derecho de propiedad sobre la aplicación ni su contenido, más allá de la licencia limitada de uso descrita en la cláusula 5.
La aplicación se apoya en servicios de terceros, entre ellos la tienda de aplicaciones (Google Play o Apple App Store), Google / Firebase y RevenueCat (que gestiona el estado de tus suscripciones y derechos de acceso; no procesa pagos). La verificación de integridad se apoya en Google Play Integrity y Firebase App Check. Los errores de contenido que nos reportas se registran en un repositorio privado de GitHub para su seguimiento técnico, en los términos descritos en la Política de Privacidad. El uso de esos servicios se rige además por sus propias condiciones y políticas, sobre las que no tenemos control.
No somos responsables del funcionamiento, contenidos o prácticas de los servicios de terceros que tú contrates o uses de forma independiente. Lo anterior no excluye ni limita nuestra propia responsabilidad imperativa ni la responsabilidad que nos corresponda por la prestación del servicio que te ofrecemos a través de estos proveedores, conforme a la cláusula 13.
La aplicación se presta «tal cual» («as is») y «según disponibilidad» («as available»). En la máxima medida permitida por la ley, no garantizamos que el contenido sea exacto, completo o esté actualizado, ni que la aplicación funcione de forma ininterrumpida, segura o libre de errores, ni que su uso te permita aprobar el examen oficial de la DGT.
ViaTest es una herramienta de práctica educativa; su contenido no constituye asesoramiento oficial, jurídico ni profesional, ni sustituye a la información oficial de la DGT. Esta cláusula no excluye ninguna garantía o derecho que la ley te reconozca de forma imperativa como consumidor. En particular, si eres consumidor en la UE y has adquirido contenidos o servicios digitales de pago, conservas íntegramente la garantía legal de conformidad que te reconoce la normativa de consumo (TRLGDCU); esta exención de garantías no excluye ni reduce dicha garantía.
En la máxima medida permitida por la ley aplicable, nuestra responsabilidad por el uso o la imposibilidad de uso de la aplicación queda limitada a los daños previsibles y directamente derivados del incumplimiento de estas Condiciones.
En la máxima medida permitida por la ley, no responderemos de los daños indirectos, consecuenciales, pérdida de beneficios, de oportunidad, de datos o de fondo de comercio. Cuando proceda exigir responsabilidad por daños derivados directamente de nuestro incumplimiento, y siempre que la ley lo permita, dicha responsabilidad se limitará al importe que hayas abonado por la aplicación en los doce (12) meses anteriores al hecho que motive la reclamación.
Nada en estas Condiciones limita ni excluye nuestra responsabilidad por: muerte o daños personales causados por nuestra negligencia; dolo o engaño fraudulento; ni cualquier otra responsabilidad que no pueda excluirse o limitarse conforme a la ley aplicable. Asimismo, nada en estas Condiciones limita ni excluye los derechos imperativos que la normativa de protección de los consumidores te reconozca; en caso de conflicto entre estas Condiciones y dichos derechos, prevalecen tus derechos como consumidor.
Eres responsable del uso que hagas de la aplicación. Si incumples estas Condiciones o haces un uso ilícito de la aplicación (por ejemplo, extracción masiva de contenido, elusión de las medidas de integridad o vulneración de derechos de terceros), responderás de los daños que ello nos cause directamente, en la medida en que sean atribuibles a tu propia conducta. Esta cláusula no te exige asumir responsabilidades más allá de lo que la ley permite imponer a un consumidor.
Podemos suspender o cancelar tu acceso a la aplicación, total o parcialmente, si incumples de forma grave o reiterada estas Condiciones o haces un uso ilícito o fraudulento del servicio, de forma proporcionada y, cuando sea razonable, previo aviso.
Cualquier suspensión o cancelación será proporcionada al incumplimiento. Si finalmente resulta que la medida fue injustificada, restableceremos tu acceso; los reembolsos del importe no disfrutado se canalizarán conforme a la política de la tienda. Si la suspensión o cancelación no se debe a un incumplimiento por tu parte, conservarás los derechos sobre las compras vigentes conforme a la política de la tienda. Puedes dejar de usar la aplicación en cualquier momento desinstalándola; las suscripciones activas deben cancelarse además en la tienda. Nada de lo anterior afecta a tus derechos imperativos como consumidor.
Estas Condiciones se rigen por la legislación española. No obstante, si eres consumidor con residencia habitual en otro país de la Unión Europea, conservas la protección que te otorguen las disposiciones imperativas de tu país de residencia habitual, que prevalecerán en lo que te resulten más favorables.
Como consumidor, podrás siempre presentar reclamaciones y ejercitar acciones ante los tribunales de tu propio domicilio; en ningún caso te obligamos a litigar en un foro extranjero. Antes de acudir a la vía judicial, puedes dirigir cualquier reclamación a support@teorico.autos y procuraremos resolverla. Como consumidor de la UE, también puedes recurrir a las entidades de resolución alternativa de litigios (RAL) competentes en tu país o a las autoridades de consumo correspondientes.
Cuando no actúes como consumidor (uso profesional o empresarial), estas Condiciones se rigen por la legislación española y las partes se someten con carácter exclusivo a los juzgados y tribunales de Valencia, con renuncia a cualquier otro fuero. Lo dispuesto en esta cláusula a favor de los consumidores prevalece para quienes actúen como tales.
Si cualquier disposición de estas Condiciones se declara nula, inválida o inaplicable por una autoridad competente, dicha disposición se interpretará en la medida mínima necesaria o, si no es posible, se tendrá por no puesta, sin que ello afecte a la validez y exigibilidad del resto de las Condiciones. Las cláusulas relativas a propiedad intelectual, licencia, exención de garantías y limitación de responsabilidad subsistirán a la terminación de estas Condiciones.
Podemos actualizar estas Condiciones. Publicaremos la versión vigente en esta página con su fecha de actualización. Los cambios menores pueden surtir efecto al publicarse, y el uso continuado de la aplicación implicará su aceptación.
Cuando los cambios sean sustanciales y te afecten como consumidor, te los comunicaremos por un medio razonable antes de que entren en vigor y no se aplicarán de forma retroactiva. Si no aceptas los cambios sustanciales, podrás dejar de usar la aplicación y cancelar tu suscripción en la tienda.

These Terms of Use (“Terms”) govern your access to and use of the ViaTest mobile app (“the app” or “ViaTest”) and its content. By downloading, installing, or using the app you accept these Terms; if you do not agree, do not use it.
The provider of the app is Aleksandr Zakrenichnyi, with registered office at Avda. Mare Nostrum 15, 46120 Alboraya, Valencia, Espana (“we”). “ViaTest” is the product’s commercial name. You can contact us at support@teorico.autos.
These Terms are supplemented by our Privacy Policy, which forms part of the agreement between you and us.
To make purchases within the app you must have the legal capacity to enter into a contract. Minors should only use the app with the consent and supervision of a parent or legal guardian. If you use the app on behalf of another person or entity, you represent that you are authorized to accept these Terms for them.
ViaTest is an educational tool to practice and prepare for the DGT (Dirección General de Tráfico) driving theory exam: practice tests with explanations and progress statistics.
The content (questions and explanations) is study material prepared by us for practice purposes; it may contain errors or may not reflect the traffic rules in force at any given time. Always check the official DGT information.
Important: ViaTest is not affiliated with, sponsored by, endorsed by, or connected in any way to the DGT (Dirección General de Tráfico) or any government body. The questions in the app are study material, they are not the official exam questions. Using the app or “passing” within it does not guarantee that you will pass the official DGT exam. The result of the official exam depends solely on the DGT and on your own preparation.
“DGT” and “Dirección General de Tráfico” are names of their respective owner and are used here solely for descriptive and identifying purposes regarding the exam for which ViaTest serves as preparation, without suggesting any connection, sponsorship, or endorsement.
When you use the app, a Firebase account is created automatically (anonymous by default). You may link a Google account or your email so that your progress and purchases are preserved when you reinstall the app and sync across your devices.
You are responsible for your account and for keeping your access credentials confidential, as well as for activity carried out through it. You will not be responsible for unauthorized activity on your account where such unauthorized access is attributable to a breach or security failure on our part and not to negligent use of your credentials. Let us know at support@teorico.autos if you detect unauthorized use of your account.
We grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to use the app and its content solely for personal and non-commercial purposes.
Except to the extent expressly permitted by law, you may not: copy, reproduce, extract in bulk or by “scraping”, redistribute, resell, sublicense, rent, or publish the app or its content; decompile, reverse engineer, or attempt to obtain the source code; or circumvent, disable, or interfere with security or integrity-verification measures (including App Check and Play Integrity).
ViaTest offers auto-renewing subscriptions of various durations (for example, 3-month, 6-month, and annual) and, optionally, a one-time “lifetime” purchase. The “lifetime” purchase grants access to premium features for as long as the app remains available and operational; “lifetime” refers to the useful life of the product and does not constitute a guarantee of perpetual, unconditional service availability.
Subscriptions renew automatically until you cancel. Payment for the renewal is charged through your store account at the start of each new period, at the then-current price. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, from your store account settings (Google Play or, where applicable, the Apple App Store).
If your subscription price increases, we will notify you through the store before the new price applies on the next renewal; you may cancel before that renewal if you do not agree. The new price will apply only after such notice and, where the store requires it, your consent.
The prices and currency you see in the app are provided by the store and may vary. Before you confirm the purchase, the store shows you the duration of each plan, the price per period, and the renewal terms; the purchase is completed only when you confirm it in the store. All payments are processed by the store (Google Play or Apple App Store); we neither receive nor store your card details. Applicable taxes apply according to the rules of the store and of your country.
You can cancel your subscription at any time from your store account settings; cancellation takes effect at the end of the current billing period and you retain access until then. You can also manage or cancel the subscription directly in Google Play or the App Store. The “lifetime” purchase is a one-time payment and does not renew.
Refunds are governed by the store’s policy (Google Play or Apple App Store), which handles charges. We recommend directing refund requests to the relevant store. If the store’s policy does not resolve your request and the law grants you a right, you can contact us at support@teorico.autos.
If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from the purchase of digital content or services, without needing to give a reason. However, for digital content and services this right may be lost if, at the time of purchase, you expressly request immediate commencement of performance and acknowledge that, in doing so, you will lose the right of withdrawal once performance has begun. If those conditions are not met, you retain the full right of withdrawal and, where applicable, a refund. The handling of this consent and of refunds is carried out through the store. The same rules apply to the “lifetime” purchase, as it is digital content with immediate access. Nothing in the above affects any rights granted to you on a mandatory basis by law.
We may modify, update, suspend, or discontinue features of the app, in whole or in part, to improve it or for technical, legal, or security reasons. We will endeavour to ensure that these changes do not substantially and unjustifiably affect premium features you have already purchased during their validity period.
If we permanently discontinue an essential premium feature you have purchased and are still enjoying within its validity period, you may request cancellation of the subscription and, where applicable, a proportionate refund through the store in accordance with its policy; this is without prejudice to your mandatory rights as a consumer.
You agree to use ViaTest in accordance with the law and these Terms. In particular, you must not: use the app abusively, fraudulently, or in a way that harms the service or other users; access it by automated means, “bots”, or in bulk; overload or attempt to breach the infrastructure; or circumvent or interfere with security and integrity-verification measures (including App Check and Play Integrity).
The app, its software, design, texts, questions, explanations, images, databases, and other content, as well as ViaTest’s trademarks, names, and logos, are owned by us or our licensors and are protected by intellectual and industrial property law. These Terms do not transfer to you any ownership right over the app or its content, beyond the limited licence to use described in clause 5.
The app relies on third-party services, including the app store (Google Play or Apple App Store), Google / Firebase, and RevenueCat (which manages the status of your subscriptions and access entitlements; it does not process payments). Integrity verification relies on Google Play Integrity and Firebase App Check. Content errors you report to us are recorded in a private GitHub repository for technical tracking, on the terms described in the Privacy Policy. Use of those services is additionally governed by their own terms and policies, over which we have no control.
We are not responsible for the operation, content, or practices of third-party services that you contract or use independently. The foregoing does not exclude or limit our own mandatory liability or the liability that falls to us for the provision of the service we offer you through these providers, in accordance with clause 13.
The app is provided “as is” and “as available”. To the maximum extent permitted by law, we do not warrant that the content is accurate, complete, or up to date, nor that the app will operate uninterrupted, secure, or error-free, nor that its use will enable you to pass the official DGT exam.
ViaTest is an educational practice tool; its content does not constitute official, legal, or professional advice, nor does it replace the official DGT information. This clause does not exclude any warranty or right granted to you on a mandatory basis as a consumer by law. In particular, if you are a consumer in the EU and have purchased paid digital content or services, you retain in full the statutory guarantee of conformity granted to you by consumer law (TRLGDCU); this disclaimer of warranties does not exclude or reduce that guarantee.
To the maximum extent permitted by applicable law, our liability for the use or inability to use the app is limited to foreseeable damages directly arising from breach of these Terms.
To the maximum extent permitted by law, we will not be liable for indirect or consequential damages, loss of profit, loss of opportunity, loss of data, or loss of goodwill. Where liability is properly due for damages arising directly from our breach, and provided the law permits, such liability will be limited to the amount you have paid for the app in the twelve (12) months prior to the event giving rise to the claim.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law. Likewise, nothing in these Terms limits or excludes the mandatory rights granted to you by consumer-protection legislation; in the event of conflict between these Terms and those rights, your rights as a consumer prevail.
You are responsible for your use of the app. If you breach these Terms or make unlawful use of the app (for example, bulk extraction of content, circumvention of integrity measures, or infringement of third-party rights), you will be liable for the damages this directly causes us, to the extent attributable to your own conduct. This clause does not require you to assume liabilities beyond what the law permits to be imposed on a consumer.
We may suspend or cancel your access to the app, in whole or in part, if you breach these Terms seriously or repeatedly or make unlawful or fraudulent use of the service, proportionately and, where reasonable, with prior notice.
Any suspension or cancellation will be proportionate to the breach. If it ultimately turns out that the measure was unjustified, we will restore your access; refunds of the unused amount will be channeled in accordance with the store’s policy. If the suspension or cancellation is not due to a breach on your part, you will retain your rights over current purchases in accordance with the store’s policy. You may stop using the app at any time by uninstalling it; active subscriptions must additionally be cancelled in the store. Nothing in the above affects your mandatory rights as a consumer.
These Terms are governed by Spanish law. However, if you are a consumer with habitual residence in another European Union country, you retain the protection granted to you by the mandatory provisions of your country of habitual residence, which will prevail to the extent they are more favourable to you.
As a consumer, you may always bring claims and exercise actions before the courts of your own domicile; in no case do we require you to litigate in a foreign forum. Before going to court, you may direct any claim to support@teorico.autos and we will endeavour to resolve it. As an EU consumer, you may also turn to the competent alternative dispute resolution (ADR) bodies in your country or to the relevant consumer authorities.
Where you do not act as a consumer (professional or business use), these Terms are governed by Spanish law and the parties submit exclusively to the courts and tribunals of Valencia, waiving any other forum. The provisions of this clause in favour of consumers prevail for those who act as such.
If any provision of these Terms is declared null, invalid, or unenforceable by a competent authority, that provision will be interpreted to the minimum extent necessary or, if that is not possible, will be deemed not to have been included, without affecting the validity and enforceability of the rest of the Terms. The clauses relating to intellectual property, licence, disclaimer of warranties, and limitation of liability will survive termination of these Terms.
We may update these Terms. We will publish the current version on this page with its update date. Minor changes may take effect upon publication, and continued use of the app will constitute acceptance.
Where the changes are material and affect you as a consumer, we will communicate them to you by a reasonable means before they take effect and they will not apply retroactively. If you do not accept material changes, you may stop using the app and cancel your subscription in the store.

Если вы используете приложение от имени другого лица или организации, вы заявляете, что уполномочены принять настоящие Условия за него.
ViaTest — это учебный инструмент для практики и подготовки к теоретическому экзамену на права DGT (Dirección General de Tráfico): практические тесты с пояснениями и статистикой прогресса.
Контент (вопросы и пояснения) — это учебный материал, подготовленный нами для целей практики; он может содержать ошибки или не отражать действующие в тот или иной момент правила дорожного движения. Всегда сверяйтесь с официальной информацией DGT.
Важно: ViaTest не аффилирован с DGT (Dirección General de Tráfico) или каким-либо государственным органом, не спонсируется, не одобрен и никак не связан с ними. Вопросы в приложении являются учебным материалом, это не официальные вопросы экзамена. Использование приложения или «сдача» в нём не гарантирует, что вы сдадите официальный экзамен DGT. Результат официального экзамена зависит исключительно от DGT и от вашей собственной подготовки.
«DGT» и «Dirección General de Tráfico» — это обозначения их правообладателя, и они используются здесь исключительно в описательных и идентификационных целях в отношении экзамена, к которому ViaTest служит подготовкой, без указания на какую-либо связь, спонсорство или одобрение.
При использовании приложения аккаунт Firebase создаётся автоматически (по умолчанию анонимный). Вы можете привязать аккаунт Google или вашу электронную почту, чтобы ваш прогресс и покупки сохранялись при переустановке приложения и синхронизировались между вашими устройствами.
Вы несёте ответственность за свой аккаунт и за сохранение конфиденциальности учётных данных для входа, а также за действия, совершённые через него. Вы не несёте ответственности за несанкционированные действия в вашем аккаунте, если такой несанкционированный доступ обусловлен нарушением или сбоем безопасности с нашей стороны, а не небрежным использованием ваших учётных данных. Сообщите нам по адресу support@teorico.autos, если обнаружите несанкционированное использование вашего аккаунта.
Мы предоставляем вам персональную, ограниченную, неисключительную, непередаваемую и отзывную лицензию на использование приложения и его контента исключительно в личных и некоммерческих целях.
За исключением случаев, прямо разрешённых законом, вы не вправе: копировать, воспроизводить, извлекать массово или путём «скрейпинга», распространять, перепродавать, сублицензировать, сдавать в аренду или публиковать приложение или его контент; декомпилировать, осуществлять обратную разработку или пытаться получить исходный код; а также обходить, отключать или вмешиваться в меры безопасности или проверки целостности (включая App Check и Play Integrity).
ViaTest предлагает автоматически продлеваемые подписки различной продолжительности (например, на 3 месяца, 6 месяцев и год) и, по желанию, разовую покупку «навсегда» («lifetime»). Покупка «навсегда» предоставляет доступ к премиум-функциям, пока приложение остаётся доступным и работоспособным; «навсегда» относится к сроку службы продукта и не является гарантией бессрочной и безусловной доступности сервиса.
Подписки продлеваются автоматически, пока вы их не отмените. Оплата продления списывается через ваш аккаунт в магазине в начале каждого нового периода по действующей цене. Подписка продлевается автоматически, если вы не отмените её не позднее чем за 24 часа до окончания текущего периода в настройках вашего аккаунта в магазине (Google Play или, где применимо, Apple App Store).
Если цена вашей подписки повышается, мы уведомим вас через магазин до того, как новая цена будет применена при следующем продлении; вы сможете отменить подписку до этого продления, если не согласны. Новая цена применяется только после такого уведомления и, если этого требует магазин, вашего согласия.
Цены и валюта, которые вы видите в приложении, предоставляются магазином и могут меняться. Перед подтверждением покупки магазин показывает вам продолжительность каждого тарифа, цену за период и условия продления; покупка завершается только тогда, когда вы подтверждаете её в магазине. Все платежи обрабатываются магазином (Google Play или Apple App Store); мы не получаем и не храним данные вашей карты. Применимые налоги начисляются согласно правилам магазина и вашей страны.
Вы можете отменить подписку в любой момент в настройках вашего аккаунта в магазине; отмена вступает в силу в конце текущего расчётного периода, и вы сохраняете доступ до этого момента. Управлять подпиской или отменить её можно и напрямую в Google Play или App Store. Покупка «навсегда» — это разовый платёж, который не продлевается.
Возвраты регулируются политикой магазина (Google Play или Apple App Store), который обрабатывает платежи. Рекомендуем направлять запросы на возврат в соответствующий магазин. Если политика магазина не решает ваш запрос, а закон предоставляет вам право, вы можете связаться с нами по адресу support@teorico.autos.
Если вы потребитель в Европейском союзе, у вас есть законное право на отказ от договора в течение 14 дней с момента покупки цифрового контента или услуг без объяснения причин. Тем не менее для цифрового контента и услуг это право может быть утрачено, если при покупке вы прямо запрашиваете немедленное начало оказания услуги и признаёте, что тем самым утрачиваете право на отказ после начала исполнения. Если эти условия не соблюдены, вы полностью сохраняете право на отказ и, при необходимости, на возврат средств. Управление этим согласием и возвратами осуществляется через магазин. К покупке «навсегда» применяются те же правила, поскольку это цифровой контент с немедленным доступом. Ничто из вышеизложенного не затрагивает права, предоставленные вам законом в императивном порядке.
Мы можем изменять, обновлять, приостанавливать или прекращать работу функций приложения полностью или частично — для его улучшения, по техническим, юридическим причинам или соображениям безопасности. Мы будем стремиться к тому, чтобы эти изменения не затрагивали существенно и необоснованно премиум-функции, которые вы уже приобрели, в течение срока их действия.
Если мы окончательно прекращаем работу существенной премиум-функции, которую вы приобрели и которой ещё пользуетесь в течение срока её действия, вы можете запросить отмену подписки и, при необходимости, пропорциональный возврат через магазин в соответствии с его политикой; это не затрагивает ваши императивные права как потребителя.
Вы обязуетесь использовать ViaTest в соответствии с законом и настоящими Условиями. В частности, вы не должны: использовать приложение недобросовестно, мошеннически или способом, наносящим вред сервису или другим пользователям; получать к нему доступ автоматизированными средствами, «ботами» или массово; перегружать или пытаться взломать инфраструктуру; а также обходить меры безопасности и проверки целостности или вмешиваться в них (включая App Check и Play Integrity).
Приложение, его программное обеспечение, дизайн, тексты, вопросы, пояснения, изображения, базы данных и прочий контент, а также товарные знаки, наименования и логотипы ViaTest принадлежат нам или нашим лицензиарам и защищены законодательством об интеллектуальной и промышленной собственности. Настоящие Условия не передают вам никаких прав собственности на приложение или его контент, помимо ограниченной лицензии на использование, описанной в пункте 5.
Приложение использует сторонние сервисы, в том числе магазин приложений (Google Play или Apple App Store), Google / Firebase и RevenueCat (который управляет статусом ваших подписок и прав доступа; платежи он не обрабатывает). Проверка целостности опирается на Google Play Integrity и Firebase App Check. Сообщения об ошибках в контенте, которые вы нам отправляете, фиксируются в приватном репозитории GitHub для технической обработки на условиях, описанных в Политике конфиденциальности. Использование этих сервисов дополнительно регулируется их собственными условиями и политиками, на которые мы не имеем влияния.
Мы не несём ответственности за работу, контент или практики сторонних сервисов, которые вы используете или с которыми вступаете в договорные отношения самостоятельно. Вышеизложенное не исключает и не ограничивает нашу собственную императивную ответственность или ответственность, которая возлагается на нас за предоставление сервиса, который мы предлагаем вам через этих поставщиков, в соответствии с пунктом 13.
Приложение предоставляется «как есть» («as is») и «по мере доступности» («as available»). В максимально допустимой законом степени мы не гарантируем, что контент является точным, полным или актуальным, ни что приложение будет работать бесперебойно, безопасно или без ошибок, ни что его использование позволит вам сдать официальный экзамен DGT.
ViaTest — это учебный практический инструмент; его контент не является официальной, юридической или профессиональной консультацией и не заменяет официальную информацию DGT. Настоящий пункт не исключает никаких гарантий или прав, предоставленных вам законом в императивном порядке как потребителю. В частности, если вы потребитель в ЕС и приобрели платный цифровой контент или услуги, вы полностью сохраняете законную гарантию соответствия, предоставленную вам законодательством о защите прав потребителей (TRLGDCU); настоящий отказ от гарантий не исключает и не уменьшает эту гарантию.
В максимально допустимой применимым правом степени наша ответственность за использование или невозможность использования приложения ограничивается предвидимым ущербом, непосредственно вытекающим из нарушения настоящих Условий.
В максимально допустимой законом степени мы не несём ответственности за косвенный или сопутствующий ущерб, упущенную выгоду, упущенные возможности, утрату данных или деловой репутации. Когда ответственность за ущерб, непосредственно вытекающий из нашего нарушения, наступает обоснованно и при условии, что это допускается законом, такая ответственность ограничивается суммой, которую вы уплатили за приложение в течение двенадцати (12) месяцев, предшествующих событию, послужившему основанием для требования.
Ничто в настоящих Условиях не ограничивает и не исключает нашу ответственность за: смерть или причинение вреда здоровью вследствие нашей небрежности; умысел или мошенническое введение в заблуждение; а также любую иную ответственность, которая не может быть исключена или ограничена согласно применимому праву. Равным образом ничто в настоящих Условиях не ограничивает и не исключает императивные права, предоставленные вам законодательством о защите прав потребителей; в случае противоречия между настоящими Условиями и этими правами преимущественную силу имеют ваши права как потребителя.
Вы несёте ответственность за использование приложения. Если вы нарушаете настоящие Условия или используете приложение незаконно (например, массовое извлечение контента, обход мер целостности или нарушение прав третьих лиц), вы отвечаете за ущерб, который это непосредственно нам причиняет, в той мере, в какой он относится к вашему собственному поведению. Настоящий пункт не требует от вас принимать на себя ответственность сверх того, что закон допускает возлагать на потребителя.
Мы можем приостановить или прекратить ваш доступ к приложению полностью или частично, если вы серьёзно или неоднократно нарушаете настоящие Условия либо используете сервис незаконно или мошеннически, — соразмерно и, когда это разумно, с предварительным уведомлением.
Любое приостановление или прекращение будет соразмерно нарушению. Если в итоге окажется, что мера была необоснованной, мы восстановим ваш доступ; возвраты неиспользованной суммы будут осуществляться в соответствии с политикой магазина. Если приостановление или прекращение не вызвано нарушением с вашей стороны, вы сохраните права на действующие покупки в соответствии с политикой магазина. Вы можете прекратить использование приложения в любой момент, удалив его; активные подписки необходимо дополнительно отменить в магазине. Ничто из вышеизложенного не затрагивает ваши императивные права как потребителя.
Настоящие Условия регулируются законодательством Испании. Тем не менее, если вы потребитель с обычным местом жительства в другой стране Европейского союза, вы сохраняете защиту, предоставленную вам императивными положениями страны вашего обычного места жительства, которые имеют преимущественную силу в той части, в какой они для вас более благоприятны.
Как потребитель, вы всегда можете предъявлять претензии и подавать иски в суды по месту вашего собственного жительства; ни в каком случае мы не обязываем вас вести разбирательство в иностранной юрисдикции. Прежде чем обращаться в суд, вы можете направить любую претензию по адресу support@teorico.autos, и мы постараемся её разрешить. Как потребитель в ЕС, вы также можете обратиться к компетентным органам альтернативного разрешения споров (АРС) в вашей стране или к соответствующим органам по защите прав потребителей.
Когда вы действуете не как потребитель (профессиональное или коммерческое использование), настоящие Условия регулируются законодательством Испании, и стороны передают споры на исключительное рассмотрение судов Valencia, отказываясь от любой иной подсудности. Положения настоящего пункта в пользу потребителей имеют преимущественную силу для тех, кто действует в качестве таковых.
Если какое-либо положение настоящих Условий будет признано компетентным органом ничтожным, недействительным или неприменимым, такое положение будет истолковано в минимально необходимой степени или, если это невозможно, будет считаться неустановленным, что не влияет на действительность и применимость остальных Условий. Положения, касающиеся интеллектуальной собственности, лицензии, отказа от гарантий и ограничения ответственности, сохраняют силу после прекращения настоящих Условий.
Мы можем обновлять настоящие Условия. Мы будем публиковать действующую версию на этой странице с датой её обновления. Незначительные изменения могут вступать в силу с момента публикации, и продолжение использования приложения будет означать их принятие.
Когда изменения являются существенными и затрагивают вас как потребителя, мы сообщим вам о них разумным способом до их вступления в силу, и они не будут применяться ретроспективно. Если вы не принимаете существенные изменения, вы можете прекратить использование приложения и отменить подписку в магазине.
